We do not warrant that Products on the Website are appropriate or available for use outside the United Kingdom. Definitions

 "We," "Us," "Our," "Starx Flag UK" refers to Hyp Commerce Ltd., a company registered in the United Kingdom, trading as Starx Flag UK.


"You," "Your," "Customer," "User" refers to the individual or entity purchasing Products from Starx Flag UK.


"Products" refers to any items, including but not limited to flags, offered for sale by Starx Flag UK.


"Customisation" refers to any modifications or changes made to the Products as requested by the Customer.

Purpose of Policy

These Terms of Sale outline the conditions under which Starx Flag UK will sell and deliver its Products to Customers. By placing an order on the Starx Flag UK website, the Customer agrees to adhere to these terms 

Scope of Policy

These Terms of Sale govern the sale of Products through the Starx Flag UK website. They do not cover any other agreements, representations, or warranties unless expressly stated in writing by Starx Flag UK.  

Policy & Procedures

1. Pricing and Payment 

1.1 Pricing: All listed prices for Products on the Website include Value Added Tax (VAT) where applicable, calculated at current rates.


1.2 Payment Methods: Starx Flag UK accepts various forms of payment as listed on the Website. All payments must be made at the time of ordering.


1.3 Currency: All transactions will be conducted in the currency specified on the Website.


2. Order Processing and Delivery


2.1 Order Confirmation: After placing an order, You will receive an email confirmation. This confirmation is not an acceptance of the order but an acknowledgment of receipt of your order.


2.2 Delivery Charges: The prices of Products do not include delivery charges. These will be added to the final amount payable and indicated during the checkout process.


2.3 Delivery Timeframes: While we strive to deliver Products within the timeframes indicated on the Website, delays may occasionally occur. We shall not be liable for any delays.


3. Customisation and Manufacturing 


3.1 Customisation Changes: You may modify the Customisation of an order up until the day the Product is manufactured. We will notify You via email when the manufacturing process commences.


3.2 Copyright and Trademarks: You are responsible for ensuring that all files sent for Customisation comply with copyright and trademark laws. Starx Flag UK is not liable for any infringement on intellectual property rights that may result from Customisation.


4. Cancellation Terms for Personalised Products


4.1 Order Changes and Cancellations for Personalised Products 


4.1.1 Standard Cancellation Window: Unless you have opted for next day delivery (see clause 4.1.2), you will have 30 minutes from the time you place your order for a Personalised Product to either change or cancel that order. After this 30-minute window, your order will proceed to production, and you will no longer be able to cancel or change it.

4.1.2 Next Day Delivery Option: If you have selected the next day delivery option, your order must be placed before 2:00 pm to receive the Product the following day. The 30-minute window to cancel or change your order will operate as outlined in clause 4.1.1.

4.2 How to Change an Order for a Personalised Product: To change an order for a Personalised Product, follow the instructions and the link provided in the email acknowledging receipt of your order. This will allow you to amend the personalisation and/or delivery address.


4.3 How to Cancel an Order for a Personalised Product: To cancel an order for a Personalised Product within the timeframes specified in clause 4.1, please contact us using one of the methods detailed in clause 10.5 (to be provided).


4.4 Spelling and Accuracy: Please verify the spelling and accuracy of any Personalised Products on screen before you place your order. You will not be entitled to a refund for any Personalised Products containing a misspelling that you are responsible for, especially if you fail to amend it within the time period specified in clause 4.1.


5. Refunds, Returns, and Exchanges

5.1 General Policy: All sales of standard, non-personalized products can be returned within 14 days of receipt for a full refund, minus the cost of shipping. To be eligible for a return, your item must be unused, in the same condition that you received it, and in its original packaging.


5.2 Personalised Products: Due to the customized nature of personalised products, items ordered with any personalisation are not eligible for a refund or return unless they are defective or damaged.


5.3 Defective or Damaged Products: If you receive a defective or damaged product, please contact us immediately at [hello@starxflag.co.uk] with details of the product and the defect or damage. You will be required to provide photographic evidence.


5.4 Exchanges: Exchanges are only permitted for defective or damaged products, and you can exchange it for the same item. If the item is out of stock, you will be offered a full refund.


5.5 Shipping for Returns and Exchanges:

The customer will be responsible for paying for their own shipping costs for returning the item, unless the product is defective or damaged. Shipping costs are non-refundable.


5.6 Refund Processing: If your return is approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within a certain number of days, depending on your payment provider.


5.7 Incorrect Orders: If you receive an incorrect order, please contact us within 7 days of receiving your order at [hello@starxflag.co.uk]. You will be required to return the incorrect product in

unused condition and will either be sent the correct product or be offered a full refund, including the cost of shipping.


5.8 Cancellation and Return Exceptions: We do not accept cancellations or returns for gift cards, downloadable products, or consumable goods such as food, flowers, and personalised items unless they are defective or damaged.


6. Data Handling and Privacy

6.1 Data Protection: We adhere to data protection regulations in accordance with our Privacy Policy. By placing an order, you agree that we may store, process, and use your personal information for the purposes of fulfilling your order.


7. Your Material and Conduct


7.1 General Rules: You agree not to submit or transmit any material that is unlawful, threatening, libellous, defamatory, obscene, pornographic, or otherwise objectionable. 


7.2 Image Upload: You are responsible for the content and legality of any images you upload for personalisation, and you warrant that you have the appropriate permissions and rights to use them.


7.3 Refusals and Responsibility: We reserve the right to refuse to process any order or image upload that violates these Terms or that we otherwise find objectionable for any reason.


7.4 Loss of Uploaded Material: We are not responsible for the preservation of any material you upload; you should keep backups of all such material.


7.5 Prohibited Material: You agree not to submit any material that violates intellectual property laws, including trademarks and copyrights.


8. Limitation of Liability


8.1 Limitations: We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data arising in connection with these Terms or the sale of the Products.
